Sofern noch keine Dienstleistungen erbracht wurden, kann diese Einwilligung jederzeit widerrufen werden. Wenn bereits Dienstleistungen erbracht wurden werden die Daten lediglich zum Nachweis der korrekten Abwicklung der bisherigen Tätigkeit (z.B.: Dokumentation der Hebammenleistung, Abrechnung der Hebammenleistung) verwendet. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf verarbeiteten Daten nicht berührt.
Ihre Daten werden nach Ablauf der gesetzlichen Aufbewahrungspflichten für Dokumentation und Abrechnung (30 Jahre bei Hausgeburten, in allen anderen Fällen 10 Jahren) unwiderruflich gelöscht. Ihre Daten geben wir nicht ohne Ihre Einwilligung weiter - mit Ausnahme gesetzlicher Verpflichtungen wie der Abrechnung.
Ich verarbeite die Daten in Übereinstimmung mit den datenschutzrechtlichen Bestimmungen.
Ihnen stehen grundsätzlich die Rechte auf Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit, Widerruf und Widerspruch zu. Wenn Sie glauben, dass die Verarbeitung Ihrer Daten gegen das Datenschutzrecht verstößt oder Ihre datenschutzrechtlichen Ansprüche sonst in einer Weise verletzt worden sind, können Sie sich bei der Aufsichtsbehörde beschweren.
(1) These General Terms and Conditions (GTC) govern the contractual relationship between midwife Lisa Marie Förster (hereinafter referred to as "Midwife") and the recipient of services (hereinafter referred to as "Participant"). By agreeing to these terms, they become part of the contract.
(2) The GTC apply to all offered courses, midwifery services, and self-paying services.
(1) Costs
The costs for childbirth preparation and postnatal recovery courses for legally insured women are billed directly with the health insurance provider. Public health insurance covers up to 14 hours of childbirth preparation and 10 hours of postnatal recovery (if completed within nine months after birth).
Missed course hours are not covered by public health insurance and must be paid by the participant (15 € per hour, regardless of the reason for absence).
Privately insured participants pay the full course fee and receive an invoice. Reimbursement by private health insurance is the responsibility of the participant.
The partner fee for childbirth preparation courses is specified in the course description and booking confirmation and must be paid in advance. It is due regardless of the partner's actual attendance.
Missed hours cannot be rescheduled. The midwife reserves the right to reschedule individual course sessions on short notice.
(2) Withdrawal and Cancellation
Online registration is binding.
The contract declaration can be revoked in writing (email to lisa-marie.hebamme@gmx.de) within 14 days after registration.
If the withdrawal occurs later than 14 days after registration or less than 14 days before the course starts, the full course fee is due unless the spot can be filled from the waiting list. In this case, an administrative fee of 5 € applies.
Once the course has started, the right of withdrawal expires according to § 356 (5) BGB.
(1) Individual midwifery care is subject to a separate treatment contract. Billing follows the Midwifery Fee Schedule.
(2) The contract will be discussed and confirmed by signature at the first appointment.
(1) A separate treatment contract applies to self-paying services (e.g., consultations, courses). The details of the service and payment terms will be agreed upon before the service is rendered.
(2) Invoices for self-paying services must be paid within the agreed period.
(1) If a course or session is canceled due to force majeure (e.g., natural disasters, pandemics, official orders) or unforeseen circumstances (e.g., illness of the midwife), a replacement date will be offered.
(2) If rescheduling is not possible, the already paid course fee will be refunded proportionally. Further claims, particularly for damages, are excluded.
(1) Participation in the courses is at one's own risk. The midwife is only liable for damages caused by gross negligence or intent.
(2) The midwife is not liable for damages due to incorrect information provided by the participant or improper execution of exercises.

Purpose of Data Processing
Data processing is carried out based on legal requirements to fulfill the treatment contract. This includes processing personal and health data. If these are not provided, care cannot be performed.
Recipients of Data
Data is only shared within the legal framework or with consent, e.g., with health insurance providers, doctors, medical laboratories, or billing offices.
Data Storage
Data is stored for at least 10 years (§ 630f (3) BGB), and in some cases up to 30 years.
Rights of the Data Subject
You have the right to access, correct, delete, and restrict the processing of your data, as well as the right to data portability and to revoke your consent.
(1) The law of the Federal Republic of Germany applies.
(2) The place of jurisdiction is the residence of the midwife, unless mandatory legal provisions dictate otherwise.
(3) If any provision is found to be invalid, the validity of the remaining provisions remains unaffected.
These GTC come into effect upon publication.
Consumers are entitled to a right of withdrawal under the following conditions: A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. The midwife/midwifery practice points out the following to the participant: You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform the midwife of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or by email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
The midwife/midwifery practice must repay all payments received from the participant immediately, but at the latest within 14 days from the day on which notification of the revocation was received. If the participant has requested that the service begin during the cancellation period, she must pay the midwifery practice an appropriate amount that corresponds to the proportion of the service used up to that point.
